Terms of Use

Apply to sportstimingbrasil.com, to the SwimSystemApp platform (swimsystem.app), to the coach, official and athlete portals, to the desktop competition modules, to the mobile apps, to the API and to our support channels.

These Terms of Use ("Terms") govern access to and use of the websites, platforms, apps and other services offered by Sports Timing Brasil ("STB", "we", "us"). They apply to people who only visit our pages, to people who hold an account and to the sports organizations that contract our solutions.

By creating an account, proceeding on a screen that refers to these Terms or simply using the services, you declare that you have read, understood and agreed to this document and to our Privacy Policy. If you do not agree, do not use the services.

The short version. STB provides the technology; the organization runs the competition. Rules, fees, deadlines, refunds and official results are its decisions.

You are responsible for the accuracy of the data you provide and for keeping your account safe. Payments are processed by a partner payment institution. This summary helps with reading but does not replace the full text below.

1. Acceptance and scope

The services are provided by STB Sistemas e Tecnologia Esportiva LTDA, trading as Sports Timing Brasil, registered under Brazilian company number (CNPJ) 47.816.373/0001-07, with offices in Curitiba/PR, Brazil. These Terms form a contract between you and STB and apply to:

  • Visitors, who browse calendars, event programs, results, records and other public pages without signing in.
  • Account holders, such as athletes, legal guardians, coaches, officials, club staff, competition operators and administrators.
  • Organizations, such as confederations, federations, leagues, clubs, schools and event organizers that contract our solutions.

If you use the services on behalf of an organization, you declare that you have authority to represent it and to bind it to these Terms. In that case, "you" also includes the organization.

Relationship with other documents

  • A contract or commercial proposal signed between STB and an organization supplements these Terms and, in case of conflict, prevails over them on the matters it specifically addresses.
  • Rules, bylaws and regulations of each organization and of each event govern the sporting relationship between you and the organization. They are not written by STB and are not part of these Terms.
  • The Privacy Policy describes how we process personal data and is part of these Terms.

2. Definitions

  • Services: the set of websites, platforms, portals, desktop modules, apps, API and support channels described in the next section.
  • Platform: SwimSystemApp, available at swimsystem.app and in the apps connected to it.
  • Organization: the confederation, federation, league, club, school or organizer that contracts the services or registers people and events in them.
  • User: any natural person who accesses the services, with or without an account.
  • Account: the individual registration, protected by credentials, that identifies the user and defines what they can access.
  • Legal guardian: the parent, guardian or other person who legally represents a minor.
  • Event or competition: the meet, stage, tournament, festival, course or activity organized by an organization and managed through the services.
  • Content: data, text, images, documents, files and other materials submitted to or published on the services by users and organizations.
  • Plan: the way an organization contracts the services, with the corresponding modules, limits and prices.
  • Payment provider: the partner payment institution that processes charges made through the platform.

3. What the services are

STB develops and operates digital solutions for managing sports organizations and events, with a strong focus on swimming, open water swimming and artistic swimming. The services include:

  • Public portal for competitions, with calendar, event program, start lists, results, live scoreboard, team scores and records.
  • Administration panel for organizations, to manage memberships, athletes, coaches, officials, clubs, competitions, entries, officiating rosters, courses, billing and reports.
  • Coach, official and athlete portals, so that each person can look after their own registration, documents, entries, assignments and credentials.
  • Desktop competition modules (SW Module, OW Module and other modules), which run the competition at the venue, including on a local network and without internet, integrated with timing equipment and scoreboards.
  • Broadcast and video board features, such as broadcast graphics and results displays.
  • Organization website, when contracted, with news, pages, documents and calendar, on a platform address or on a custom domain.
  • Mobile apps, when available.
  • API and integrations, to exchange data with the organization's own systems and with third-party systems.
  • Online collection of entry fees, other fees and annual dues, through the payment provider.
  • Support: support center, help center, e-mail, WhatsApp and status page.

The features available to each user depend on their access profile, on the plan contracted by the organization and on the settings it adopts. The services evolve continuously: we may add, change or discontinue features, giving reasonable notice when the change materially reduces what was already in use.

4. Who is responsible for what

STB is a technology provider. It is not a sports governing body, it does not organize or promote the competitions managed on the platform and it takes no part in the sporting relationship between organizations, clubs, coaches, officials and athletes. This division of roles defines the responsibilities of each party.

Official and competition operatorThe entries, checks and records they make during the event, according to the role assigned to them by the organization.
Athlete and legal guardianAccuracy of their own data, fitness to take part in the sport and compliance with the event rules and the organization's regulations.

Questions, appeals and complaints about membership, eligibility, rejected entries, disqualification, placing, records or refunds must be addressed to the organization in charge, through the channels it indicates. STB has no power to review those decisions.

5. Registration, eligibility and accuracy of information

Who can hold an account

  • To create and manage an account you must be 18 or older and have full legal capacity.
  • Minors take part through the registration made by the organization, by the club or by the legal guardian. Where an account exists in the name of a minor, it must be created and supervised by the legal guardian, who is responsible for the acts performed.
  • Organization accounts are operated by people it has authorized. The organization is responsible for granting, reviewing and revoking the access of its staff.

Relationship with the organization

Most registrations are made within an organization. Approving, rejecting, deactivating or ending the registration of an athlete, coach, official or club is the sole decision of the organization, taken under its own rules. Holding an account on the platform does not create a right to membership, entry or participation in an event.

True and up-to-date data

  • You agree to provide true, complete and up-to-date data, and to correct it whenever it changes.
  • Each person must use their own documents. Entering the tax ID (CPF) or document of another person, including a family member, in the registration of an athlete, coach or official is prohibited.
  • We may check registration data against official databases and authorized providers. In case of mismatch, the registration may remain pending until it is resolved.
  • Each person must have a single registration. Duplicate registrations may be merged by the organization or by STB.
  • Whoever registers third parties, such as a club registering athletes, declares that they are authorized to do so and, in the case of minors, that they have the legal guardian's authorization.

We may refuse, suspend or cancel registrations containing false or incomplete data or data belonging to third parties, without prejudice to the measures available to the organization and to the civil and criminal liability of whoever provided it.

6. Credentials and account security

  • Access credentials (password, codes sent by e-mail, passkeys and sign-in through third-party identity providers, such as Apple and Google, when available) are personal and non-transferable.
  • You are responsible for keeping your credentials confidential and for all activity carried out in your account, including by people you have allowed to access it.
  • Do not share the account. Each member of an organization's or club's staff must have their own access.
  • Keep the registered e-mail address under your control: it is where we send codes, password resets and important notices.
  • When using shared computers, such as those at the competition desk, sign out when you finish. In the desktop modules, the saved sign-in has a limited duration and may require you to authenticate again.
  • Tell us immediately at support@sportstimingbrasil.com if you suspect unauthorized access, loss or leakage of credentials.

For security reasons, we may require re-authentication, end sessions, reset credentials and temporarily block access showing signs of misuse.

7. Acceptable use and prohibited conduct

The services must be used in good faith, for the sporting and administrative purposes they are intended for. You must not:

  • Violate the law, third-party rights, these Terms or the rules of the organization and of the event.
  • Provide false data, impersonate another person or enter an athlete without authorization.
  • Tamper with or attempt to manipulate entries, times, results, rankings, scores, records, credentials or documents.
  • Access, or attempt to access, data, accounts or areas of another organization or person without authorization, or circumvent access controls and technical limits.
  • Test, probe or exploit vulnerabilities, run scans, denial-of-service attacks or any action that degrades or overloads the infrastructure.
  • Extract data in bulk by automated means (scraping, bots, crawlers) outside the official API and the limits it sets.
  • Use personal data obtained through the services for any purpose other than sports management, such as marketing, building commercial databases or unsolicited contact.
  • Copy, modify, decompile, reverse engineer or create derivative works of the software, except where the law expressly allows it.
  • Resell, sublicense, rent or assign access to the services without written authorization from STB.
  • Use the services to develop a competing product or service.
  • Send viruses, malicious code, spam or content that is unlawful, offensive, discriminatory, defamatory or that violates the rights of children and adolescents.
  • Remove or hide copyright notices, trademarks and other indications of ownership.

We use automated protection mechanisms, which may limit requests, require additional checks or block addresses and networks showing abusive behavior. Failure to comply with this section allows us to suspend or terminate access, as set out in the section on suspension.

Found a vulnerability? Write to support@sportstimingbrasil.com with the description and the steps to reproduce it, without accessing third-party data and without disclosing the flaw before it is fixed. We appreciate the help of those who report in good faith.

8. Memberships, entries, competitions and results

Memberships and entries

  • Membership and entry in an event are relationships between the participant, or their club, and the organization. The platform is the means by which they are recorded.
  • Deadlines, categories, qualifying standards, event limits, quotas, fees and required documents are defined by the organization and applied as it has configured them.
  • Check the data before confirming. An entry is only valid once the event conditions are met, such as approval by the organization and payment, where required.
  • Changes, substitutions, withdrawals and late entries follow the event rules.

Results, rankings and records

  • Times and results originate from timing equipment and from data entered by operators and officials appointed by the organization.
  • Information shown in real time, on the video board, on the live scoreboard or on the portal, is provisional until made official. The official result is the one ratified by the organization.
  • Rankings, scores, standings and records are calculated according to the rules configured by the organization. Corrections and reviews are decided by it.
  • Protests and appeals follow the event rules and must be submitted to the organizing body.

Event documents

Credentials, bulletins, score sheets, certificates, reports and receipts generated by the platform are issued in the name and under the responsibility of the organization that requests them.

Health and safety

Taking part in sports activities involves inherent risks. The platform does not assess physical or medical fitness and is not an emergency service. Event safety, medical assistance and the requirement of medical certificates are the responsibility of the organizing body and of the participant or their legal guardian.

Images and broadcasting

The capture and use of images and video at events, including in broadcasts, are defined by the organizer in the event rules and participation terms. The public disclosure of sports data is described in the Privacy Policy.

9. Payment of entries, fees and annual dues

Charges made through the platform are processed by Asaas Gestão Financeira Instituição de Pagamento S.A., or by another payment provider that may be indicated, using the methods available for each charge (such as PIX, boleto bank slip and card). STB is neither a financial institution nor a payment institution and does not store full card numbers.

Whose money it is

The amounts of entries, fees and annual dues are set by the organization and belong to it. STB acts as a technology intermediary. The platform service fee and the payment provider's charges may be deducted from the amount paid, in accordance with the contract between STB and the organization.

For the payer

  • Check the amount, the beneficiary and the charge details before paying.
  • Confirmation depends on settlement by the chosen payment method, which has its own timeframes. Overdue charges may be cancelled, and the entry may cease to be valid.
  • Late payment may incur a fine, interest and other charges stated on the charge itself.
  • The payment receipt is available on the platform. The tax document for the entry, where due, is the responsibility of the receiving organization.

Cancellation and refunds

  • Cancellation of entries and refunds follow the policy of the organizing body and the event rules. The request must be made to it.
  • Once a refund is approved, the reversal is processed through the same payment method and is subject to the timeframes of the payment provider and, for cards, of the card issuer.
  • If the event is cancelled or postponed, it is up to the organizing body to define and communicate how the amounts paid will be handled.
  • The rights provided by the Brazilian Consumer Protection Code remain preserved, including the right of withdrawal, where applicable.

Disputes

Disputing a payment with the bank or card company ("chargeback") may lead to the suspension of the corresponding entry until the case is resolved. Improper or fraudulent disputes make the person responsible liable for the amounts and subject to the measures provided in the organization's rules and in the law.

The organization's receiving account

To receive payments through the platform, the organization holds a receiving account with the payment provider, subject to that provider's registration, review and terms. Settlement timeframes, holds, preventive blocks and documentation requirements determined by the provider or by a regulatory authority are not under STB's control.

10. Plans, subscriptions and billing of organizations

This section applies to organizations that contract the services. Athletes, coaches, officials and visitors do not pay STB for using the portals.

  • Plan and modules. The modules, limits and conditions of use are those of the contracted plan or of the commercial proposal accepted by the organization.
  • Price. The remuneration may combine a recurring amount (monthly or annual), a percentage fee on the amounts received through the platform and one-off services. In the absence of an active plan, the standard fee in force applies to the amounts received.
  • Recurring billing. Invoices are issued every cycle, with the payment methods and due date stated on them. Renewal is automatic until cancellation.
  • Late payment. Failure to pay by the due date makes the organization liable for the fine, interest and other charges stated on the invoice. If the delay continues beyond the grace period, access to features may be suspended until payment is settled, with data preserved during the suspension.
  • Price adjustment. Prices may be updated annually by the variation of the Brazilian IPCA inflation index, or the index that replaces it, and may be changed with at least 30 days' notice, the change taking effect from the following cycle.
  • Cancellation. The organization may cancel the plan at any time, effective at the end of the cycle already paid. There is no pro rata refund for a period already started, unless the law or the contract provides otherwise.
  • Taxes. STB issues a service invoice for the services it provides. Each party is responsible for the taxes it owes.
  • Services under proposal. On-site timing, event operation, training, data migration and custom development are contracted under their own proposal, with specific scope and price.

11. Content from organizations and users

Ownership and license

Content submitted to the services continues to belong to whoever submitted it or to its respective owners. By submitting it, you grant STB a non-exclusive, royalty-free, worldwide license, for as long as necessary, to host, store, reproduce, process, adapt to the display format and publish that content for the sole purpose of providing the services, in accordance with the publication settings chosen by the organization.

Your warranties

  • You declare that you hold the necessary rights and authorizations over the content you submit, including athlete photos, club and sponsor logos, rules and documents.
  • The content must not infringe copyright, trademarks, image rights, reputation, privacy or any other third-party right.
  • The organization is editorially responsible for everything it publishes on its website, on its event pages and in its announcements, including when it uses a custom domain.

Organization websites

The content of websites maintained by organizations on the platform is filtered for security reasons: elements that could compromise the page or its visitors, such as scripts and embeds from non-approved sources, are removed automatically. Setting up a custom domain depends on changes at the organization's domain provider, which are its own responsibility.

Content removal

We may remove or disable content that violates these Terms or the law, that poses a security risk or whose removal is ordered by a competent authority. To report content you consider unlawful, write to support@sportstimingbrasil.com with the page address and a description of the problem.

Feedback and aggregated data

Suggestions and comments sent to STB may be used freely to improve the services, with no obligation of payment. We may also produce aggregated and anonymized statistics about the use of the platform, which identify neither people nor organizations.

12. Intellectual property and license to use

The software, source code, interfaces, layouts, database structure, documentation and other elements of the services, as well as the trademarks Sports Timing Brasil, SwimSystemApp, SW Module, OW Module and their logos, belong to STB or to its licensors and are protected by Brazilian Laws No. 9,609/1998 (software), No. 9,610/1998 (copyright) and No. 9,279/1996 (industrial property).

  • We grant you a limited, non-exclusive, non-transferable and revocable license to use the services while these Terms are in force, within the limits of your access profile and of the organization's plan.
  • Nothing in these Terms transfers to you any ownership right over the services. Rights not expressly granted are reserved to STB.
  • Use of STB's trademarks requires prior authorization. Client organizations may state that they use our solutions, respecting the brand's visual identity.
  • Trademarks, names and logos of sports organizations, sponsors and equipment manufacturers shown in the services belong to their respective owners.
  • Open source components included in the services are governed by their respective licenses.

13. Desktop modules and mobile apps

Installation and updates

  • The desktop modules may be installed on the computers of the organization and of its authorized operators, for use at the organization's own events or at events it operates.
  • The modules and apps may download and install updates automatically. Keeping the version up to date may be a condition for continuing to use the service, and old versions may stop being supported.

Offline and local network operation

  • During operation without internet, data is stored on the local computer until it is synchronized with the cloud. Safekeeping of the equipment, completing the synchronization and checking what was sent are the responsibility of whoever operates the event.
  • The event's local network, including passwords, equipment and who has access to it, is the responsibility of whoever operates it.
  • Power, internet, computers and other resources at the venue are the responsibility of the organizing body.

Third-party equipment

Integration with timing systems, scoreboards and other third-party equipment depends on the model, version, configuration and condition of that equipment. We indicate the models we work with, but we do not guarantee compatibility with all equipment and are not liable for failures of third-party hardware, cabling or software.

Mobile apps

Apps distributed through stores, such as the App Store and Google Play, are also subject to the terms of those stores. The stores are not a party to these Terms and are not responsible for the apps or for their support. Notifications can be turned on or off in the device settings.

14. API, integrations and data import

  • API keys are issued to the organization, are confidential and must not be exposed in public code or shared with unauthorized third parties. The organization is responsible for the use made with its keys.
  • Use of the API is subject to request limits and to the documentation in force. We may suspend keys in case of abuse, security risk or violation of these Terms.
  • We may evolve the API and discontinue versions, giving reasonable notice when the change is incompatible with existing integrations.
  • Data obtained through the API remains subject to these Terms and to data protection law. Whoever receives it is responsible for the use they make of it.
  • Using the API to replicate the services or to redistribute data contrary to the organization's authorizations is prohibited.

Import and export

The services import and export files in industry formats (such as LENEX and SDIF), spreadsheets and data from third-party systems. Whoever imports a file is responsible for its content and for checking the outcome of the import. Third-party formats and systems may change without notice, which may temporarily affect compatibility.

15. Third-party services and external links

The services rely on providers of infrastructure, payment, e-mail delivery, authentication and registry lookup, listed in the Privacy Policy. The use of features provided by third parties may also be subject to those providers' terms.

The services may contain links to third-party websites and content, including those of the organizations themselves. We do not control those environments and are not responsible for their content, practices or availability.

16. Privacy and data protection

The processing of personal data in the services follows the Privacy Policy, which explains which data we process, for what purposes, with whom we share it and how to exercise your rights.

Organizations as controllers

With regard to the data of athletes, coaches, officials and other participants that it enters or manages on the platform, the organization is the controller and STB is the processor. The organization is responsible for:

  • Having a legal basis for each processing activity and, where necessary, the consent of the data subject or of the legal guardian, especially in the case of minors.
  • Requesting only the data necessary for sporting and administrative purposes.
  • Responding to data subject requests and keeping the records required by law.
  • Instructing its own staff and revoking the access of those who leave their role.
  • Notifying STB, without delay, of any suspected incident involving the platform.

Users with access to other people's data

Administrators, club staff, coaches, officials and operators who access other people's data must keep it confidential and use it only for the sporting or administrative purpose that justified the access, even after their relationship with the organization has ended.

17. Availability, maintenance and support

  • We use reasonable efforts to keep the services continuously available, but we do not guarantee uninterrupted or error-free operation.
  • Scheduled maintenance is announced in advance whenever possible. Emergency, security or corrective interventions may take place without prior notice.
  • Incidents and maintenance are reported on the status page.
  • Service levels, response times and on-call support at events are only enforceable when provided for in a contract or proposal with the organization.
  • Support is provided through the support center, by e-mail and by WhatsApp, during the hours published on those channels.
  • We maintain backup routines for the platform. They do not replace the organization's own checking of its data or the export of what it considers essential.
  • Internet connection, an up-to-date browser and compatible equipment are the user's responsibility.

18. Features in testing, automatic calculations and artificial intelligence

  • Features in testing. Features identified as experimental, beta or pre-release are offered for evaluation, may change or be withdrawn at any time and may have limitations.
  • Automatic calculations. Age and category checks, seeding, timing, scoring, placings and records follow the rules configured by the organization. It is up to the organization to check the configuration and the result before making it official.
  • Artificial intelligence. Features assisted by artificial intelligence, such as reading event documents to turn them into structured data, may contain errors and must be reviewed by a person before taking effect.
  • Registry checks. Checking documents against third-party databases depends on the availability and accuracy of those databases.

19. Warranties and disclaimers

We provide the services with diligence and in line with good industry practice. Even so, to the fullest extent permitted by law, the services are provided as is, with no warranty that they will meet every specific need, that they will operate without interruptions or errors or that they will be compatible with all equipment, browsers or systems.

STB is not liable for:

  • Sporting, administrative, disciplinary or financial decisions of the organizations.
  • Incorrect, incomplete or outdated data entered by users and organizations, nor for the results arising from it.
  • Failures of third-party equipment, power, internet or the event's local network.
  • Unavailability of providers and third-party services beyond our reasonable control.
  • Use of the services contrary to these Terms, to the documentation or to the law.
  • Unauthorized access resulting from the user's failure to safeguard credentials.

Nothing in this section excludes statutory warranties that cannot be excluded, in particular those provided by the Brazilian Consumer Protection Code.

20. Limitation of liability

  • To the fullest extent permitted by law, STB is not liable for indirect damages, loss of profits, revenue, opportunity or data, reputational harm, or losses arising from the cancellation, postponement or change of events.
  • In relationships with contracting organizations, STB's total liability, for any cause, is limited to the amount actually paid by the organization to STB in the 12 months preceding the event that gave rise to the damage.
  • Neither party is liable for a failure caused by force majeure, such as widespread power or telecommunications failures, large-scale cyberattacks, weather events, acts of authority and unavailability of essential providers.

These limitations do not apply in cases of willful misconduct or gross negligence and do not exclude liabilities that the law does not allow to be limited, including towards consumers and data subjects.

21. Indemnification

You agree to indemnify STB, its partners, staff and business partners for losses, awards and reasonable expenses, including attorneys' fees, arising from third-party claims caused by:

  • Breach of these Terms or of the law.
  • Content you submitted to or published on the services.
  • False information or use of third-party data without authorization.
  • In the case of organizations, decisions taken and data processing carried out as event organizer and as data controller.

22. Suspension and termination

By you

You may stop using the services at any time and request the closure of your account by e-mail at support@sportstimingbrasil.com. Historical sports records, such as results and records, and data subject to statutory retention are kept in accordance with the Privacy Policy.

By the organization

The organization may approve, deactivate or end the registrations of people and clubs within its scope and revoke the access of its staff, under its own rules.

By STB

We may suspend, restrict or terminate access, in whole or in part, in case of breach of these Terms, well-founded suspicion of fraud, risk to the security of the services or of third parties, non-payment by the organization or legal requirement. Whenever possible we will give prior notice and an opportunity to remedy. In urgent situations, the measure may be immediate.

Effects of termination

  • The licenses granted under these Terms end.
  • The organization may request the export of its data in a commonly used format within 30 days after the contract ends. After that, the data is deleted or anonymized, except for statutory retention periods and the historical record of sports results.
  • Amounts due up to the termination date remain payable.
  • Provisions that by their nature should survive remain in force, such as intellectual property, limitation of liability, indemnification, data protection and jurisdiction.

23. Changes to these Terms

These Terms may be changed to reflect legal, technical, commercial or service changes. The date of the last update and the version appear at the top of the page. Material changes are communicated with reasonable notice through our official channels or prominently on the platforms.

Using the services after the new version takes effect means you agree to it. If you do not agree, you may stop using the services and request the closure of your account. Where the law requires a new acceptance, it will be requested.

24. Communications

  • You agree to receive communications by electronic means: registered e-mail, notices on the platforms, app notifications and WhatsApp. These communications are valid as written communications.
  • Operational notices about the account, entries, payments, competitions and security are part of the service and are sent while the account is active. Marketing communications depend on your consent and can be cancelled at any time.
  • Keep your contact details up to date. A communication sent to the last registered e-mail address is considered delivered.
  • Formal communications to STB must be sent to support@sportstimingbrasil.com or to the address shown at the end of this document.

25. General provisions

  • Entire agreement. These Terms, the Privacy Policy and, where applicable, the contract or proposal signed with the organization constitute the entire agreement between the parties regarding the services.
  • No waiver. Failure to exercise a right does not mean waiver or novation.
  • Severability. If any provision is held invalid, the remaining provisions stay in force.
  • Assignment. You may not assign your rights and obligations without STB's consent. STB may assign them to a successor or to a company in the same group, in a corporate reorganization, keeping the guarantees of these Terms.
  • Independent parties. These Terms do not create a partnership, association, agency, representation or employment relationship between STB and users or organizations.
  • Integrity. The parties undertake to comply with anti-corruption legislation, in particular Brazilian Law No. 12,846/2013.
  • Language. These Terms are written in Portuguese and also made available in English. In case of discrepancy, the Portuguese version prevails.

26. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Before any legal action, the parties will seek an amicable solution through STB's support channels.

The courts of Curitiba/PR, Brazil, are elected to settle disputes arising from these Terms, without prejudice to the consumer's right to choose the courts of their own domicile and to the data subject's right to apply to the data protection authority.
